Resolving Post-Closing Disputes—The Arbitration Route

In this paper written for the recent CLEBC course: Legal Strategies in Private Mergers and Acquisitions, the author focuses on certain arbitration-related considerations of particular relevance when assessing whether the dispute resolution clause that you are contemplating (or that is already found in your contract) constitutes an arbitration agreement, whether to include an arbitration clause in a contract, and how the clause should be drafted.
