BCSC rules abductor must pay costs under Hague Convention

The B.C. Supreme Court in Beatty v. Schatz, 2009 BCSC 769, ruled that the Supreme Court Rules provisions on costs do not apply to Convention cases; the Hague Convention anticipates that the abductor pays the costs of securing the child’s return so that the left-behind parent is restored to the financial position he or she would have been in but for the abduction.
