BCSC sets aside summary judgment obtained in foreclosure proceedings (Case Digest)

The B.C. Supreme Court in Canada Mortgage & Housing Corp. v. Bhalla has set aside a default judgment obtained in foreclosure proceedings, finding it would be a miscarriage of justice to let the judgment stand when there is a defence worthy of investigation as to whether the defendant is liable on the mortgage covenant.
