Restitution is an important and sometimes overlooked area of the law— it is said to be one-third of the common law. This area of the law is essentially concerned with providing remedies where one party has been deprived and another unjustly enriched. Restitution is not straightforward—there are a number of theoretical and practical issues shaping this area of the law. The course will be a comprehensive introduction to critical elements and current issues in the law of restitution. The objective of the program will be to provide civil litigation counsel with another set of tools for their arsenal for tort claims.
At this course you will learn about...
- the current state of this important remedy
- the strategic and tactical considerations that shape asserting and defending against a claim in restitution
- the role of conduct and contractual elements in restitution
- the range of restitutionary remedies that are available
