Identifying, assessing, and managing family violence and power imbalances in dispute resolution process design
The Family Law Act’s approach to family law emphasizes out-of-court dispute resolution, and creates new duties for family dispute resolution professionals. As of March 18, 2013, those duties include assessing whether family violence may be present, and helping clients assess which dispute resolution processes might best keep them and their children safe and empower them to negotiate effectively. For many, ending an intimate partnership is a time of danger. The danger can be physical, with those at risk including former partners, children, family members, and the abuser. The danger can also be emotional or psychological, resulting from mental illness, emotional abuse, the stress of a separation, or the personalities of the parties involved. ”Family violence” is defined broadly to include all elements of physical and emotional violence and abuse. Research shows that family lawyers and other family law professionals often fail to ask the questions needed to properly assess risk, and may often fail to recommend the most appropriate dispute resolution processes for their clients. This highly interactive two-day workshop using lectures, current literature, research and statistics, real case studies, role-playing, coaching and in-class discussion, and the guidance of trained coaches, is designed to meet the training requirements under the amended Family Law Act and Regulation.
