The British Columbia jurisprudence surrounding tort causation continues to evolve under a “robust and pragmatic” common sense approach as directed by the Supreme Court of Canada in Clements and Ediger. With this year’s program the focus shifts to a review of the tests for causation with an analysis of the practical implications of the tests for the assessment of liability, the assessment of damages, and specific issues in the litigation context. Particular attention will be paid to examples from recent decisions of the Supreme Court of BC and the Court of Appeal for BC. The comprehensive full-day program will assist you to develop a solid grasp of the theoretical issues and underpinnings of the law of causation and how to apply the law in litigation contexts such as personal injury and medical negligence. This course is for intermediate level litigators who want to sharpen their understanding of causation as it relates to a broad spectrum of litigation matters.

  • how to apply the "but for" test for causation and understand how the "but for" test interfaces with evidentiary issues
  • the "material contribution test" for causation and when it applies
  • remoteness and proximate cause and the distinction between factual cause and legal cause
  • the application of tests of causation in the litigation context, and the implications of the causation tests for litigation strategy and preparation
  • how to be more effective in presenting and challenging expert evidence bearing upon issues of causation
