Causation in Tort III – Tuesday, May 5, 2015
The British Columbia jurisprudence surrounding tort causation continues to evolve under a “robust and pragmatic” common sense approach as directed by the Supreme Court of Canada in Clements and Ediger. With this year’s program the focus shifts to a review of the tests for causation with an analysis of the practical implications of the tests for the assessment of liability, the assessment of damages, and specific issues in the litigation context. Particular attention will be paid to examples from recent decisions of the Supreme Court of BC and the Court of Appeal for BC. The comprehensive full-day program will assist you to develop a solid grasp of the theoretical issues and underpinnings of the law of causation and how to apply the law in litigation contexts such as personal injury and medical negligence. This course is for intermediate level litigators who want to sharpen their understanding of causation as it relates to a broad spectrum of litigation matters.

Toxic Torts 2015 – Wednesday, May 6, 2015
Toxic torts are torts that arise from environmental contamination or a toxic product. The scope of toxic tort law is broad and far ranging, from toxic products and the human body at one end of the spectrum, to industrial processes and toxic effects on the environment at the other end. This comprehensive one-day course will introduce you to the main issues shaping this important and dynamically evolving area of the law. The program will examine the legal doctrines underlying toxic torts, scientific evidence and proof of toxic torts, government litigation and toxic torts, class actions in toxic tort, and the problem of causation in toxic torts. This intermediate level course is for civil litigators who deal with tort claims involving individuals as well corporate entities.
