Learning level: All levels

Almost every business has confidential information from which it derives some value or revenue. Often this may not be the archetypal trade-secret (i.e. a recipe, a code, or an algorithm) but is something like a customer list, a way of doing business, or a novel process which has a value that is driven by the simple fact that it is kept confidential and is not in the public domain. Protecting and enforcing breaches of trade secrets or confidential information is important for many businesses and during this program, you will learn:

  • what confidential information is
  • how to identify and protect it
  • how to enforce breaches to ensure that your confidential information remains confidential

This is the 1st course in the Intangible Business Assets Series, a 4-part CLE-TV series on trade-marks and brands, reputation and goodwill, confidential information, designs, and inventions that will help you to advise your clients on how to get ahead and deal with problems like:

  • a former employee uses confidential information (trade secrets, customer lists, etc.) to compete with your client's business
  • a vendor uses its knowledge of your client's technology to compete with your client or do work for the competition
  • your client wants to sell their business, but discovers that their software is legally owned by the programmer who wrote the software program

Other sessions in the Intangible Business Assets Series are:

II.  Protecting and Using Patents & Designs
III. Protecting and Using Copyright
IV. Protecting and Using Trade-marks

Law Society of BC CPD Hours: 1 hour This course will NOT involve aspects of professional responsibility and ethics, client care and relations, and/or practice management.
