Who should attend: All litigators who handle files with a personal injury (direct or resulting) loss component.

Learning level: Fundamental/Intermediate

Along with causation and liability, the assessment of damages or quantum is one of the central aspects of all personal injury files. This course is a comprehensive review of the essential elements and building blocks of personal injury files damage assessment—from what must be reviewed, to how medical and accounting evidence is to be marshalled to arrive at that critical dollar value which constitutes the quantum assessment of an injury. Junior lawyers will find this course a comprehensive review of what they need to know, and experienced counsel will benefit from a helpful review which may fill in some gaps in knowledge.

At this course you will learn...

  • the principles and case law foundation governing non-pecuniary damages
  • how to most effectively marshal the elements of evidence that will prove or challenge a non-pecuniary claim
  • the principles and legal framework governing the calculation of pecuniary damages
  • the elements of lay and expert evidence which will establish or effectively challenge a claim in pecuniary damages
  • how to manage a claim that has elements of future damages
  • how to pull together the legal and evidentiary strands to deliver a persuasive argument at trial
