The digital revolution continues to re-shape and re-define the process of civil litigation. With the rise of electronically stored information comes an array of issues relating to the management, search, and presentation of such digital information. 

In the pre-trial context comes the issue of using computer software to assist with searching electronically stored data; this issue is particularly important where there is a very large database. In the trial preparation and trial conduct context there are issues relating to the fidelity and admissibility of evidence in an electronic format. 

This comprehensive one-day program will quickly bring practitioners up to speed on current issues and best practices for effectively managing electronic evidence in the litigation process.

At this course you will learn: 

  • what electronic evidence is and the challenges it presents to litigators
  • about eDiscovery and how this process raises a new array of expectations for counsel, clients, and all parties
  • the admissibility principles of evidence and how they  apply in the electronic realm
  • about issues surrounding the authentication of electronically stored information
  • how to manage electronic information from the internet
  • how to manage digital forensic evidence
  • about ethics and professionalism issues around electronic information
  • the View from the Bench on issues and best practices in managing electronically stored information

Law Society of BC CPD Hours: 6 hours (a minimum of 1 hour will involve aspects of professional responsibility and ethics, client care and relations, and/or practice management)
