Who should attend: Civil litigators.
Learning level: Intermediate
The stated object of the 2010 Supreme Court Civil Rules is to secure the "just, speedy and inexpensive determination of every proceeding on its merits". A critical tool in that array is Rule 9-7 Summary Trial. This course is a comprehensive review of the principles and strategic and tactical considerations that go into assessing and framing (or challenging) a matter that is under consideration as a summary trial. We will examine the jurisprudence surrounding summary trials and provide practical practice points for managing summary trial files.
This course is for intermediate level counsel and will also be valuable for experienced counsel who seek an update and refresher. If you are an experienced litigator and "Summary Trial" brings to mind Rule 18A—you need this refresher!
At this course you will learn:
-
the case law on summary trial and the strategic considerations governing whether your file is appropriate for summary trial
-
how to prepare for summary trial: from pleading and argument to preparing evidence and procedural steps
-
practical tips for managing a summary trial from the View from the Bench
