As a 5% tax, practitioners all too frequently overlook the impact of the GST in their transactions. But in the real estate sector where transaction values are high, the GST can add up to big dollars very quickly. How does one respond when the client looks to the law firm for advice on the potential pitfalls or savings in relation to transaction taxes? When you ask the seller to sign the GST exemption certificate at closing, have you briefed the seller on the liability he or she may be assuming unnecessarily?
This course will provide an overview of the basics of GST and PST issues when advising in connection with the development, construction, and sale of residential real estate. In addition to the basics of what is taxed and how and when it is taxed, the course will review current issues arising in the residential real estate sector. This includes the application of GST to residential care homes, the assignment of purchase contracts, long-term residential leases, developments on First Nation Lands, joint ventures, and bare trust issues. The course will also review the rules for the application of BC’s provincial sales tax to construction activity.
