Who should attend: Crown and defence criminal lawyers, at all levels of experience; law enforcement officers.

The practice of criminal law in Canada continues to evolve on a number of different fronts reflecting the dynamic interplay of social trends, social science, technology, legislation, and law enforcement techniques. This unique one day program will examine select issues of current import and interest for criminal lawyers and law enforcement officers alike. Topics will include cell phone searches, digital evidence from electronic devices, law relating to privilege, including informant privilege, warrantless searches and roadside stops, law firm searches and incriminating evidence, legislative searches and their analogues. Criminal lawyers, both crown and defence at all levels of experience, along with law enforcement officers, are encouraged to attend this wide-ranging program.

At this course you will learn about...

  • electronic data: how it is gathered by police and the legal issues which must be addressed before such data can be tendered as electronic evidence
  • special searches: an area where there are limitations on accessing what would otherwise be relevant evidence and grounds for a search warrant
  • privilege: an important exclusionary rule of evidence governing many facets of criminal practice
  • informant privilege: a subset of privilege unique to criminal law
  • roadside stops: a way that many accused are brought into the criminal justice system—but what about the Charter implications?

Law Society of BC CPD Hours: 6 (For Rebroadcasts: a minimum of 1.25 hours will involve professional responsibility and ethics, client care and relations, and/or practice management)
