About the Course Chairs
Frank A.V. Falzon, QC graduated from the UVic Faculty of Law in 1986, where he received the Law Society Gold Medal. In 1987-1988, he was appointed to serve as a law clerk at the Supreme Court of Canada. He was called to the Bar of BC in 1989 and commenced practice with the constitutional and administrative law section of the Ministry of Attorney General. Frank entered private practice in Victoria in November 1995, and since that time has acted as legal counsel to a number of statutory decision-makers and officers of the legislature. He has appeared as counsel before administrative tribunals and has appeared at all levels of court in Canada. He has served as a member of several administrative tribunals, has lectured in administrative law, has published several law review articles, is an editor and contributor to CLEBC’s Administrative Law Practice Manual and has conducted numerous administrative law training seminars for statutory decision-makers.
Elena F. Miller is senior in-house legal counsel for the BC Labour Relations Board and the BC Employment Standards Tribunal. She provides internal legal advice to Board and Tribunal staff and adjudicators, and has appeared as counsel for the Board and Tribunal in all levels of court on judicial reviews, appeals, and related matters. She has been seconded to six-month appointments as a Vice-Chair of the Board and a Member of the Tribunal.
Elena has presented papers at administrative and labour law conferences and authored and updated two chapters of CLEBC’s British Columbia Administrative Law Practice Manual. This is her third year as co-chair of the CLEBC Administrative Law Conference.

The Right Honourable Richard Wagner earned a Bachelor of Social Sciences (B.Soc.Sc.) with a major in Political Science from the University of Ottawa in 1978, graduating cum laude. He received a Licentiate in Laws (LL.L.) from the University of Ottawa’s Faculty of Law in 1979, also graduating cum laude.
Richard Wagner was called to the Quebec Bar in 1980 and practised law until being appointed to the Quebec Superior Court on September 24, 2004. He was a partner in the law firm of Lavery, de Billy (formerly Lavery, O’Brien and Lavery, Johnston, Clark, Carrière,
Mason & Associés) from 1980-2004. He argued cases before all the Quebec courts and quasi-judicial tribunals, as well as before the Federal Court and the Supreme Court of Canada.
In 1998, he was a founding Fellow of the Canadian College of Construction Lawyers (CCCL). In 1989-1990 and in 2001, he taught trial advocacy courses at the École du Barreau du Québec. He was elected First Councillor of the Bar of Montréal for 2000-2001 before being elected Bâtonnier of the Bar of Montréal for 2001-2002.
On September 24, 2004, Richard Wagner was appointed to the Quebec Superior Court for the District of Montréal, where he sat in the Civil Division, the Commercial Division and the Criminal Division. He was appointed to the Quebec Court of Appeal on February 3, 2011.
In June 2005, he received the Barreau du Québec’s Award of Merit in recognition of his contribution to the legal profession and, in particular, to the creation of the Centre d’accès à l'information juridique (CAIJ) which has provided access to legal information for members of the profession throughout Quebec since 2002. He was a member of the CAIJ’s board of directors and its vice-president until being appointed to the Quebec Superior Court.
He was appointed to the Supreme Court of Canada on October 5, 2012, and appointed Chief Justice of Canada, December 18, 2017.
David J. Mullan retired from the Faculty of Law at Queen’s University, Kingston, Ontario, Canada in 2003 as the holder of the Osler, Hoskin & Harcourt Professorship in Constitutional and Administrative Law. From 2004-2008, he was the first Integrity Commissioner for the City of Toronto and now works as a free-lance consultant and speaker. From 1998-2006 he was a part-time member of the Human Rights Tribunal of Ontario, and, until 2015, a part-time Vice-Chair of the Ontario Workplace Safety and Insurance Appeals Tribunal. Until 2018, he was also a member of the NAFTA Chapter 19 Canadian Panel and continues to provide strategic advice on administrative law issues to various agencies. He has been a frequent speaker at continuing legal education seminars and workshops for members of courts, tribunals, and agencies as well as the profession. David is widely published in the field of administrative law and has prepared reports for various governments and agencies.
