This course is the successor to CLEBC’s highly successful course Causation in Tort After Resurfice held in June 2008. This year we expand the program to 1 1/2 days. Day 1 will focus on substantive law and will include discussion of: current factual causation law and issues, “but for” and inference causation, class actions issues, toxic torts issues, clarifying causation, causation in medicine, causation in construction and insurance, damages, causation and responsibility for loss, and multiple causes: "but for", material contribution, proximate cause/remoteness, NESS, probability and belief, and a US factual causation law primer for Canadians. The featured dinner speaker is Mr. Justice Ian Binnie of the Supreme Court of Canada.
Day 2 (1/2 day) will open with a featured video link presentation from Lord Hoffmann, formerly of the House of Lords, who will speak on "Causation in English Law". This day will continue with an appellate advocacy demonstration by senior counsel and appellate judges using factual causation issues presented in a fact pattern based on Walker Estate v. York Finch Gen'l Hospital.
This unique and comprehensive program will present a stellar team of counsel, jurists, and tort scholars from across Canada, the United States, and England.
