For solicitors, it is a fact of life that a certain percentage of files will give rise to disputes and that a further subset of these files will proceed to litigation. Given this reality, it is also true that there isn’t a “standard model” for the process and timing of the transition from being a solicitor’s file to a litigator’s file. More importantly, there are steps that can and should be taken by a solicitor to manage a file in transition. Indeed, there are traps and pitfalls for the unwary. These course materials examine key ways in which solicitors can prevent litigation and manage files that appear headed for litigation. Topics include: managing litigation costs, litigating your contract negotiations, choice of law and choice of forum, the dispute resolution spectrum, and principles of privilege.
