Too often dispute resolution clauses receive little focus when negotiating a deal. Whether parties are simply unwilling to spend time contemplating future problems or counsel believe that the options available for dispute resolution are sufficiently covered in standard precedent clauses, agreements are often made without examining the best possibilities for the specific deal.

Panelists will draw from their varied practice backgrounds to identify common pitfalls in the drafting of dispute resolution clauses that miss opportunities to prevent and manage disputes and may even escalate future problems.

Panelists will speak from their experiences across a wide range of practice contexts, including:

  • modern treaties
  • major projects development
  • entertainment, video game, and sports contracts
  • corporate/commercial transactions
  • media regulation
  • real estate development
